Right to information is a fundamental right and if any issue arises while exercising the right there is a remedy for it in the statue. When the applicant is not happy with the response of the First Appellate Authority can file a second appeal in the Information commission at the centre or respective states the remedy is provided under section 19(3) of the RTI act, 2005. The application is send to the respective authority in written. When the matters are related to the central government public authority complain is send to central information commission and the matter related to the state government public authority complain is send to the state information commission.
When the second appeal can be filed
The second appeal can be filed within 90 days from the date the first appellate information was finally received or within 90 days after expiry of 45 days of filing the first RTI in the cases where no reply has been received.
Procedure of filing the RTI
- Write an application to the centre information commission or state office commission, the applicant can also ask for the personal hearing. The application must be signed.
- The following documents should be attested with the application – the copy of first RTI application
- the copy of RTI first appeal
- postal receipts
- delivery proof
- ID proof of the applicant
# Self-attested means the document should be signed and write attested on every document by hand.
- Post the application only via speed post or by registered AD.
- There is no time limit specific for the response for the second appeal by the commission except 90 days.
- There is no fee for the second appeal.
