Right to information is a fundamental right of the Indian citizen according to the Indian constitution. When the answer of the initial RTI application is not received by the applicant or he is not satisfied with the information he has received the first appeal is made to the officer who is at the higher rank of the Public information officer. Section 19(1) of the RTI act, 2005 provides the right of first appeal.

The RTI act 2005 mandates the Public information officer must provide the information was asked by the applicant within the specified time period. First appeal is specially files when the applicant gets no response or unsatisfactory reply or incorrect information.

Who can apply for the First appeal of the RTI?

  1. The applicant who is not satisfied or not received the information within the 30 days of the date of receipt can file the RTI First appeal.
  2. Third party, to whom the information is asked for, relates to or has been supplied to confidential.

The right to first appeal as explained U/s 19(1) OF THE RTI act, 2005 can be exercised in the following situation:                                                                                                                                    The first appeal is made to the senior officer than the IPO for more transparency and clear response.

  1. The PIO fails to give reply within the 30 days.
  2. The information received is incomplete and unsatisfactory.
  3. The third party whom PIO consulted and the party is not satisfied with the result.

Process of filing the First Appeal

An application is to be written to the Central Public Information officer on the same address the initial RTI was send. Application may contain information the date of filing RTI and request to send the reply or correct information

Following documents must be attached to the First appeal.

  • Copy of Application which was sent to the PublicInformation Officer.
  • Copy of postal order.
  • And copy of record sent by the speed post.(no need of new postal order)
  • There is no fee for the first appeal.
