What is Trademark Renewal?

The registration of a trademark is valid only upto a period of 10 years after which it can be renewed. Renewal of a trademark preserves those rights that are available only to registered trademarks. If the proprietor fails to renew the trademark, then he/she loses all the protection that comes with the trademark.

It is valid for 10 years at a time and is renewable indefinitely.

The Trademark Registry has classified goods and services under 45 classes. Your application must mention the class/classes the goods/services represent. The trademark would be registered under those classes only

A trademark in India can be renewed by filling the trademark renewal form. A trademark should be renewed 6 months before the trademark expiration term, else a late renewal fee is to be paid for renewal after six months.

In case, no application for renewal has been filed, or in case no fee for renewal has been paid, the Registrar may remove the mark from the register.

If in case the renewal period has lapsed and no application was filed prior to the expiration, then the proprietor can apply for restoration of the trademark. However, such an application has to be made from 6 months to 1 year after the expiration of such registration.
