Importance of a Website Privacy Policy

If we focus on the word privacy, it means a state which makes an individual and his property free from outer disturbance. It may include free from publicity, secret surveillance or unauthorized disclosure of one’s personal data or information, as by any foreign personality. Our Constitution does not grant in specific and express terms any right to privacy as such, it is the Supreme Court who culled out this right from Article 21 and several other provisions of the Constitution read with the Directive Principles of State Policy. Same is the case of the privacy of the websites as these are also the property of the individuals.

A privacy policy is one of the most important documents on any website. It details your company’s views and procedures on the information collected from visitors.Although a privacy policy is technically a legal document, great effort should be made to craft a document that is both accurate and easy to understand, obscuring hidden clauses in reams of text is not acceptable. In specific, with respect to the website privacy policy no provision has been made but then also websites requires privacy. For the requirement of the privacy varied reasons can be there, such as the documents which are available there are not for all the users who browsed the website or with the concern for what purpose the data available on their sites will be used, with regard to their intellectual rights and who sees their information. Privacy policy is a kind of surety to the website owner that their information will not be used in any marketing efforts or from that any fraudulent purpose will not. The concern for the privacy policies of the websites arises due to the prevalence of the internet spam as it has become an annoying and progressive problem for many consumers.

Privacy policy of the website serves various purposes such as,

  • It can access the information only when proper authenticity of the user has been proved.
  • It, to some extent, controls the crimes (cyber tort, etc.) which are prevalent on the cyber space.
  • To safeguard the personal information from scattering, the inclusion of privacy policy on the websites becomes an important factor.
  • By putting privacy policy of the website unnecessary headache of the owner reduces.
  • Having an accurate Privacy Policy on your website is important, not only to the company but to the visitors as well, privacy policy of the website does not only protect the companies or the web portals but they also serve interests of the individual and their information who are the users of the respective sites.
  • The user’s information will be protected while being active and then safely deleted by who offers secure document/hardware destruction services.

That’s why privacy policy of the website must be in a language that is easy to read and understand, explain what information is being collected and why and must include how it is collected as well, sharing information with a third-party be clear about what you are sharing. Website Terms and Conditions are essential in, among other things, establishing the ownership rights of the website operator in and to the applicable content and offerings featured on the website, limiting the liability of the website operator in connection with the website and its content/offerings, establishing payment terms (if any) and setting forth the terms for dispute resolution in the privacy policy. Overall, a privacy policy of the website must have proper introduction, what information has been collected, what method is to be adopted to collect the information, how is the information stored and proper contact details must be provided to the consumers if in case of any query, contact can be easily made.

Technically speaking, Privacy Policy is a disclosure statement. It is used to inform the website visitors of just how protected their personal information is when they visit your site. On a more legal stance, the FTC, COPPA and other legislators can actually bring legal cases against any website whose Privacy Policies are not correct. In fact, many sites have been taken down completely due to misinforming consumers about how that site uses their personal information. Although you may mean well by posting the policy, you need to ensure that it completely represents your company in order to keep yourself free facing legal problems in the future.
