In country like India there is always some conflicts between the laws and morality in which society generally accept the morality and display it as a law which should be binding. In such cases people get confused about what actually law is. The very common example of this situation is that people thinks it is illegal to book and stay in a single hotel room if couples are not married. But this is not the reality as no law in India prohibit unmarried couples to stay in a single hotel room.

Legality of staying in same hotel room by unmarried couple-

It is totally legal if unmarried couple stay in same hotel rooms. There is no such law which can prevent you from doing so and also you have right to personal liberty under Article 21 of the Indian constitution under which you can claim it as an infringement of your fundamental right if a person wants to stop you from doing so. In India people usuallyconsider a thing to be illegal if it is unacceptable by society or by their own morals so, it is very important to have clear understanding of such things so that you can protect your own rights.

Refusal by hotels to give accommodation on the ground that couples are unmarried-

According to the Hotel Association of India, there is no law that permits the denial of accommodation, on the grounds that the people staying are an unmarried couple. However, some hotels reserve their right to refuse certain people. This action is taken by the hotels to prevent the unnecessary interference. Such practice is acceptable in India as far as it does not violate the Article 15 which prohibits discrimination on the ground of religion, race, cast, sex etc. now a days demand of couple friendly hotels are increasing so number of such hotels are also increasing so, you can choose any of such hotels to avoid problem.

Harassment by police to unmarried couples taking single hotel rooms-

It became a usual practice in India that police officers harass the unmarried couples if they are staying in a single room on that it is illegal by some way. But police have no such right to do so unless you are doing something which is actually illegal. Police have different right for prevention of crime but it does not meanthat they can violate right of others. Following are some common methods which police uses to harass and the way in which you can save yourself from any trouble-

  1. Indecent Public Behaviour- In such cases police generally put the charges of indecent public behaviour which is also not a suitable for this act as for this offence act must be done at public place while hotel rooms are not covered under public place.
  2. Take photographs of you, or videotape you, with the intention of harassing you in public or in front of your parents- There is no as such law which can prevent a person from taking your pictures but it done without your consent then it is clear violation of your privacy. So, in such cases you can prevent it on the ground of violation of your privacy.
  3. Charges based on ‘Abduction’ of the girl- It is also very common practice that the parents or police officer puts charges of abduction on the male partner but if you are not actually doing any of such things then you have no need do worry about it as you are protected by law itself.
  4. Extortion– sometimes police officer takes money from such couples by extorting the. You must know that extortion is a criminal offence so you can make then liable for that.

It is not enough to have rights which can protect you but it is also very important that you must have knowledge about it because if you don’t know what rights you have then how can you be able to enforce them. It is important that one can differentiate between what is illegal under law and what is illegal in eyes of society because you are only abide by law and by the perception of the society.
