Who is a Legal Heir and What is a Legal Heir Certificate?

Legal Heir is the person who represents a deceased person. In case of an unexpected death in the family, Legal Heir Certificate is the legal document that specifies the legal heirs of a person. It is used to establish a relationship between the deceased person and heirs and is used to avail various benefits etc.

An important condition for applying to be a Legal Heir is that the deceased had not appointed a nominee during his/her lifetime

Necessary Documents for Application to be Legal Heir

  • Death Certificate
  • Identity proof of the deceased
  • Self-attested PAN card of the Legal heir or any other Identity Proof (Voter’s ID, Aadhar Card, Driving License, Passport or any other government issued identity card)
  • An affidavit or a self-undertaking by the applicant on stamp paper.
  • Residence Proof of both the applicant and the deceased.
  • Service Certificate issued by the head of department/office in case of a serving employee

Under the Indian Law following people can apply to be legal heirs

How to Apply to be a Legal Heir

The authority for issuing of Legal Heir Certificate is the District or TalukTahsildar.All the necessary documents along with an application have to be submitted and a form has to be filled. It requires a nominal court fee which is waived for persons of Scheduled Castes and Schedules Tribes.

After this, an inquiry for verification is conducted by the local revenue officers or the village administrative officials.

After the due inquiry, based on the report presented by the revenue officer and village administrative officials the certificate will be issued by the competent authority in which names of all the legal heirs will be mentioned.

Time taken for Processing of Application:An application for Legal Heir can take anywhere between 15 to 45 days approximately.
